Welcome to ReptiSitter. These Terms of Service ("Terms") govern your access to and use of the ReptiSitter platform, website (repti-sitter.com), mobile applications, and all related services (collectively, the "Service") operated by Reptisitter LLC ("Company," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility & Age Requirement

You must be at least 18 years of age to create an account, use the Service, or engage in any transactions on ReptiSitter. This applies to all users, including customers, sitters, and ambassadors.

Minor Sitter Exception: Individuals under the age of 18 may apply to become a sitter only if a parent or legal guardian provides written consent and agrees to co-supervise all sitting engagements. The guardian must complete a Guardian Consent Form and will be jointly responsible for the minor's obligations under these Terms. Guardian consent is subject to verification and approval by ReptiSitter at its sole discretion.

By creating an account, you represent and warrant that you are at least 18 years old or have obtained valid guardian consent as described above.

2. Account Registration

To use certain features of the Service, you must create an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and update your information to keep it accurate and current
Maintain the security of your password and account
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that contain inaccurate information or that violate these Terms.

3. Types of Users

ReptiSitter supports the following user types:

Customers (Pet Parents): Individuals seeking reptile sitting services for their pets.
Sitters: Independent contractors who provide reptile care services through the platform. Sitters must complete a background check and profile verification before accepting bookings.
Ambassadors: Individuals who promote ReptiSitter and refer new sitters or customers in exchange for commissions and other benefits.

Users may hold multiple roles (e.g., a sitter may also be an ambassador). Each role is subject to its specific requirements and obligations.

4. Sitter Requirements & Background Checks

All sitters must:

Complete the sitter application process
Consent to and pass a background check conducted by our third-party verification partner
Maintain an accurate and up-to-date profile
Comply with the Independent Contractor Agreement
Provide services in a professional and caring manner

Sitters are independent contractors, not employees of Reptisitter LLC. The relationship between sitters and the Company is governed by the Independent Contractor Agreement.

5. Booking & Payment Terms

All bookings are made through the ReptiSitter platform. Payment is processed securely through Stripe. By making or accepting a booking, you agree to the following:

Customers are charged the total booking amount at the time of checkout
ReptiSitter retains a platform service fee (currently 20% of the booking total)
Sitters receive the remaining amount via Stripe Connect direct deposit
Promotional discounts (e.g., first-time booking discounts) are applied at checkout and reduce the sitter's earnings, not the platform fee
All prices are displayed in US Dollars (USD)

6. Cancellation Policy

Cancellation terms may vary by booking. Generally:

Cancellations made more than 48 hours before the scheduled service may receive a full refund
Cancellations made within 48 hours may be subject to a cancellation fee
No-shows by the customer will be charged the full booking amount
Sitters who cancel confirmed bookings may face account penalties or suspension

7. User Conduct

You agree not to:

Use the Service for any unlawful purpose
Provide false or misleading information
Harass, abuse, or harm other users
Attempt to circumvent the platform to avoid fees
Interfere with the proper functioning of the Service
Scrape, harvest, or collect user data without authorization
Impersonate any person or entity

8. Intellectual Property

The ReptiSitter name, logo, branding, and all content on the platform (excluding user-generated content) are the property of Reptisitter LLC. You may not use, reproduce, or distribute our intellectual property without prior written consent, except for approved marketing materials provided through your sitter or ambassador dashboard.

9. Limitation of Liability

To the maximum extent permitted by law, Reptisitter LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from:

Your use of or inability to use the Service
Any conduct or content of any third party on the Service
Injury to or death of any animal in a sitter's care
Any unauthorized access to or use of your account

ReptiSitter serves as a platform connecting pet owners with sitters. We do not guarantee the quality of services provided by sitters, although we take reasonable measures (background checks, verification) to ensure sitter reliability.

10. Indemnification

You agree to indemnify and hold harmless Reptisitter LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in the State of Washington, in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

12. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is otherwise objectionable. You may also delete your account at any time by contacting our support team.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

14. Modifications to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the platform. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.
